Today, CIRO / OCRI published for comment the third phase of our Rule Consolidation Project. The Federation of Independent Dealers (FID) supports leveling advisor compensation between investment and mutual fund dealers. In response to CIRO's Position Paper on leveling the advisor compensation playing field, FID submitted a comment letter. - FID has concerns about potential need for increased oversight, and risk of additional taxation. - FID prefers the existing directed commission approach, and believes existing tools can support the noted transparency objectives. The Federation of Independent Dealers (FID) advocates for competitive equivalence between investment dealers and mutual fund dealers. In response to CIRO's Rule Consolidation Project - Phase 2, FID proposes: ✅ Removing ETF education restrictions for dual-platform firms ✅ Adjusting IDPC rules for MFDs dealing in ETFs or debt securities ✅ Exempting non-executing introducing members from annual reviews of internal best execution policies FID also proposes enabling MFDs to offer a broader range of products and services. To my financial advisor colleagues: In 2023, I argued a trilogy of (the first ever) contested penalty hearings related to pre-signed and altered forms before the #MFDA and #CIRO. The recent surge in fines sought by enforcement staff has made these issues critical for advisors. Michelle Schriver of Advisor.ca has examined the outcomes of these hearings and their potential implications for your profession. I highly recommend giving her article a read to stay informed. What are your thoughts on these developments?
Financial advisors have begun contesting the penalties for pre-signed forms violations, resulting in lower sanctions than recommended by their regulator. Nonetheless, "advisors have very little leverage when it comes to negotiating a penalty," says lawyer Zachary Pringle.
